## Welcome to Tunearo

Tunearo is a UK-based music distribution platform serving artists and labels around the world.

These Terms of Service ("Terms") govern your use of our website at Tunearo.com and our mobile applications (collectively, the "Platform") and the services we provide through them (the "Services").

By accessing or using our Platform or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Platform or Services.

*Important:* We may update these Terms from time to time. When we do, we will notify you by email (if you have provided one) and/or by posting the updated Terms on our Platform. The updated Terms will be effective 30 days after we provide notice, unless you object by contacting us within that period.

## 1. Eligibility and Account Registration

### 1.1 Age Requirements
You must be at least 18 years old to use our Services. If you are between 13-17 years old, you may only use our Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

We may suspend or terminate your account if you:

- Engage in fraudulent or illegal activity
- Repeatedly upload prohibited content

Where possible, we will provide reasonable notice and opportunity to remedy breaches, except for serious violations.

### 5.2 Effect of Termination
Upon termination:
- Your access to our Services will cease
- We will provide reasonable access to retrieve your content (subject to legal requirements)
- Outstanding payments owed to you will be processed according to our standard procedures

## 6. Disclaimers and Limitation of Liability

### 6.1 Service Availability
We strive to maintain reliable service but cannot guarantee uninterrupted availability. We are not liable for temporary interruptions or technical issues.

### 6.2 Limitation of Liability
To the fullest extent permitted by law, our total liability to you will not exceed the amount you paid us in the 12 months preceding the claim.

*Consumer Rights:* Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded under applicable law

6.3 Third-Party Partners and Services

Tunearo may engage third-party companies or individuals (“Partners”) to provide certain parts of our Services, including but not limited to music distribution, payment processing, and technical infrastructure.
While we carefully select our Partners, we do not control their operations and cannot guarantee their continued performance or availability.

Accordingly, Tunearo is not liable for any delays, errors, interruptions, or failures in service caused by third-party Partners, provided that we act in good faith and take reasonable steps to resolve any such issues.

If a Partner fails to perform, Tunearo will make reasonable efforts to:

Communicate with affected users,

Migrate affected services to a new provider, and

Minimize any disruption to your releases or earnings.

Your sole remedy in such cases will be limited to discontinuing use of our Services or, where applicable, a refund of fees paid for the affected period.

## 7. Data Protection

We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR. You have rights regarding your personal data, including rights of access, correction, and deletion.

## 8. Dispute Resolution

### 8.1 Complaints Process
If you have a complaint, please contact our customer support team first. We will acknowledge complaints within 2 business days and aim to resolve them within 14 days.

### 8.2 Alternative Dispute Resolution
If we cannot resolve your complaint directly, you may be eligible for alternative dispute resolution through approved ADR schemes.

These Terms are governed by the laws of England and Wales. UK courts have jurisdiction over any disputes, subject to your rights to bring proceedings in your country of residence if you are a consumer.
